Judge rules cities can ban marijuana stores

In a precedent setting court case, a Pierce County judge ruled Friday that local governments can ban marijuana businesses even though they’re legal in the state.

Tedd Wetherbee wanted to open a marijuana store in Fife, a Tacoma suburb that banned recreational marijuana stores. He sued the city, saying he’s entitled to do business under Initiative 502, the law that legalized retail marijuana.

Judge Ronald Culpepper ruled that nothing in Initiative 502 overrides local governments’ authority to regulate business through zoning or other means.

Currently, the City of Ferndale has a moratorium on marijuana businesses.
